Use of the Business and Human Rights Documentation Project (“B-HRD” or the “Project”) website (the “Site”) is provided by the Center for Human Rights and Global Justice (CHRGJ) and the International Network for Economic, Social and Cultural Rights (ESCR-Net) subject to the following Terms and Conditions ("Terms").
Reservation of Right to Modify. B-HRD reserves the right to modify these Terms at any time. In the event that B-HRD modifies these Terms, B-HRD’s revised Terms shall be effective immediately upon the posting of such revised Terms. Your continued use of the Site following the posting of any revised Terms shall be deemed to conclusively indicate your acceptance of such revised Terms. Accordingly, you should periodically re-review these Terms. If you disagree with the Revised Terms, DO NOT USE the Site.
Acceptable Use of the Site. You may use the Site for lawful purposes only.
Information provided “as is” . To the extent permitted by law, B-HRD excludes all liability for any loss or damages including, without limitation, indirect, special or consequential loss or damages, or any loss or damages arising from the use or in connection with such use or loss of use of the website, whether in contract or in negligence.
No warranties. B-HRD does not make any express or implied warranties, endorsements or representations whatsoever as to the operation of B-HRD’s Site or the accuracy or completeness of any information, content, or materials thereon. B-HRD does not necessarily agree with the views expressed in the materials on the Site or support the organizations named on the Site. B-HRD recommends that users of the Project Site also check the mandate, standards, and accuracy of human rights organizations named on the Site on the organizations’ websites and other websites. B-HRD recognizes that businesses may have ceased their activities discussed on the Site since the date of publication of these reports. B-HRD uses reasonable efforts to share only reports based on sound methodology, but does not independently verify the accuracy of the legal and factual claims which may be made in these reports.
Representations. B-HRD does not make any legal representations regarding the material presented on the website and no materials herein constitute legal advice. B-HRD makes no guarantee of the factual accuracy of the articles and reports it makes available. B-HRD posts reports submitted by third parties and assumes no responsibility for checking or researching the accuracy of those materials. The reports are the opinion of the authors and based on the authors’ research. The content of the reports is not intended to malign any nation, religion, race, ethnic group, gender, club, organization, company or individual. The views of the authors are their own and do not in any way reflect the views of B-HRD or any of its affiliates.
Sole Risk. You expressly agree that use of the Site is at your sole risk. Neither B-HRD, its affiliates nor any of their respective employees or agents warrant that the Site will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the Site or as to the accuracy, reliability or content of any information provided through the Site or through any pages connected to the Site by hypertext links.
International Use. B-HRD makes no representation that Content of the Site and any services available through the Site in accordance with these Terms are appropriate or available for use in locations outside the United States. Accessing the Site from countries, states or territories where the Site Content is illegal is strictly prohibited. Those who access the Site from locations outside the United States do so at their own risk and are responsible for compliance with all applicable local laws.
Jurisdiction. You hereby agree that these Terms and your use and viewing of or access to the Site shall be governed in all respects by the internal substantive laws of the State of New York, without regard to its conflicts of laws provisions. You hereby submit to exclusive jurisdiction and venue in the state and federal courts located in the State of New York for all disputes, cases and controversies regarding this Site and your use of it.
Copyrighted Material. Third parties (“Author Organizations”) provide content that is distributed on the Site. Unless indicated to the contrary, these Author Organizations shall retain responsibility and liability for any material provided to B-HRD for publication. To the extent the Site contains copyrighted material including trademarks (registered or unregistered), text, software, photos, designs, video, graphics, music, sound and other proprietary information, that material is and shall remain the property of the copyright owner. All rights are reserved on these materials and permission to copy them must be requested from the copyright owners. You shall be solely liable for any damage resulting from any infringement of copyrights.
Infringement Policy. In accordance with the U.S. Digital Millennium Copyright Act, you agree to notify B-HRD by writing to the Project Administrators if you believe you have a claim of copyright infringement with respect to material posted on the Site.
Correction Policy. B-HRD’s policy is to use reasonable efforts to provide accurate information on the Site. If B-HRD, at its sole discretion, determines that a report or material on the Site contains false, unfair or inaccurate information, B-HRD addresses the issue at the earliest opportunity and may revise or remove such information. B-HRD encourages users to submit requests for correction by clicking here.
